Directive 2011/83/EU — Digital content

General principle

Consumers residing in the European Union have 14 days to withdraw from an online purchase, without having to provide any reason.

Exception for digital content

Under art. 16 letter m) of Directive 2011/83/EU, the right of withdrawal **does not apply** to the supply of digital content not delivered on a tangible medium (e.g. software download) if performance has begun with the consumer's express consent and acknowledgment that they thereby lose the right of withdrawal.

By proceeding with the payment and downloading the file, the consumer confirms wanting to start the supply immediately and waives the right of withdrawal.

When withdrawal is still possible

  • The buyer has paid but has not yet downloaded the product.
  • The product turned out to be substantially different from the description (refund request, not withdrawal).
